Terms of Service

These Terms of Service (“Terms”) govern your access to and use of FindUnfollower, including the website at https://findunfollower.com, the web application at https://app.findunfollower.com, and related services, features and functionality (together, the “Service”).

FindUnfollower is operated by Erkan Afacan, of Flat 23, 55 Primrose Hill Rd, London, NW3 3EA, United Kingdom (“FindUnfollower”, “we”, “us” or “our”).

By creating an account, purchasing a subscription or otherwise using the Service, you agree to these Terms.

If you do not agree to these Terms, you must not use the Service.

1. About FindUnfollower

FindUnfollower helps you analyse information contained in an Instagram data export that you obtain directly from Instagram.

Depending on the features available to you, the Service may allow you to:

identify accounts you follow that do not follow you back;
compare follower and following information;
identify accounts that appear to have stopped following you between exports;
review follow requests and other supported relationship information;
compare multiple exports over time;
add notes, statuses, whitelist entries or other annotations; and
view statistics based on information contained in your exports.

FindUnfollower does not require your Instagram password.

We do not log in to Instagram on your behalf and do not automatically follow, unfollow, message or otherwise interact with Instagram accounts for you.

FindUnfollower is not affiliated with, endorsed by, sponsored by or officially associated with Instagram or Meta Platforms, Inc.

2. How the Service Works

You are responsible for obtaining your Instagram data export directly from Instagram and providing the relevant export to FindUnfollower.

FindUnfollower processes information from supported portions of that export to generate the results shown to you.

The accuracy and completeness of the results depend on the information contained in your export.

For example, an Instagram export generated for a limited date range rather than “All time” may omit information and therefore produce incomplete or misleading results.

Instagram may also change its export format, data structure or functionality at any time. Such changes may temporarily affect FindUnfollower's ability to analyse an export correctly.

We do not control Instagram, Meta or the contents or accuracy of the exports they provide.

3. Eligibility

You may use FindUnfollower only if:

you are at least 16 years old or have reached any higher minimum age required to enter into this agreement where you live;
you are legally capable of entering into a binding agreement; and
your use of the Service is permitted by applicable law.

If you are using FindUnfollower on behalf of a company or other organisation, you confirm that you have authority to accept these Terms on its behalf.

4. Your Account

Some features require a FindUnfollower account.

You agree to provide accurate information when creating your account and to keep relevant information reasonably up to date.

You are responsible for protecting access to your account and for activity carried out through it where caused by your failure to keep your credentials secure.

If you believe someone has accessed your account without permission, contact us promptly at info@findunfollower.com.

You must not:

create accounts using false or misleading identities;
impersonate another person;
share an account in a way intended to bypass subscription or usage limits; or
use another person's account without permission.

5. Google Sign-In and Other Authentication Providers

FindUnfollower may allow you to create an account or sign in using a third-party authentication provider such as Google.

When you use Google Sign-In, your relationship with Google is also governed by Google's applicable terms and policies.

FindUnfollower may receive basic account information that you authorize Google to provide, such as your:

Google Account identifier;
email address; and
name or basic profile information.

Google Sign-In is used for account creation and authentication. Unless explicitly disclosed otherwise, FindUnfollower does not use Google Sign-In to access your Gmail messages, Google Drive files, Google Calendar, Google Contacts or other Google services.

Our collection and use of personal information received through Google or another authentication provider is described in our Privacy Policy:

You may revoke FindUnfollower's Google authorization through your Google Account settings. Revoking Google authorization does not necessarily delete your FindUnfollower account; account deletion is handled separately through FindUnfollower.

6. Subscriptions, Free Trials and Payments

FindUnfollower may offer free and paid plans.

The features, usage limits, billing period and current prices for each plan are described on our Pricing page and during checkout.

Free plans

A free plan may provide limited functionality, limited results or other usage restrictions.

We may change the features or limits of a free plan from time to time.

Paid subscriptions

Paid subscriptions provide the features displayed for the selected plan at the time you subscribe.

Unless the checkout page expressly states otherwise, paid subscriptions are billed for the billing period shown when you purchase the subscription.

Free trials

Certain paid plans may begin with a free trial.

Before you start a trial, we will display:

the length of the trial;
the subscription that begins after the trial;
the amount you will be charged;
the billing frequency; and
how to cancel.

If you start a free trial that automatically converts to a paid subscription, your selected payment method will be charged when the trial ends unless you cancel before the end of the trial.

The exact trial duration presented to you at signup forms part of your subscription agreement.

Automatic renewal

Unless otherwise stated during checkout, paid subscriptions automatically renew at the end of each billing period.

By purchasing an automatically renewing subscription, you authorize us and our payment provider to charge the applicable subscription price to your selected payment method on each renewal date until you cancel.

You can stop future renewals by cancelling your subscription as described below.

Payment processing

Payments are processed by Stripe or another payment provider identified during checkout.

We do not store your complete payment-card details.

Your payment provider may process your payment information under its own terms and privacy policy.

Taxes

Prices and applicable taxes will be shown during checkout as required.

You are responsible for any taxes that apply to your purchase except taxes imposed directly on our income.

7. Cancellation

You may cancel your subscription using the cancellation functionality provided in your FindUnfollower account.

Unless otherwise stated:

cancellation prevents your subscription from renewing;
you will not be charged for the next billing period;
your existing paid access normally continues until the end of the period you have already paid for; and
cancelling a subscription does not automatically delete your FindUnfollower account.

You may separately delete your account through the account settings where that functionality is available.

We aim to make cancelling a subscription reasonably straightforward and will not require you to contact us solely to stop an ordinary automatic renewal where in-product cancellation is available.

8. Consumer Cancellation and Refund Rights

Nothing in these Terms limits any cancellation, refund or other consumer rights that cannot legally be excluded.

Depending on where you live, you may have statutory rights in addition to the contractual cancellation rights described above.

For example, consumers in the United Kingdom or European Economic Area may in certain circumstances have a statutory cancellation period for contracts entered into online.

Where the law requires us to obtain your express request or consent before beginning a paid digital service during a statutory cancellation period, we will request that consent as part of the purchase process.

If you exercise a statutory cancellation right, any refund or amount payable for services already supplied will be determined in accordance with applicable law.

Nothing in these Terms affects your statutory rights where the Service:

is not provided with reasonable care and skill;
is not as described;
does not meet rights provided to you by applicable consumer law; or
otherwise entitles you to a remedy under applicable law.

9. Price Changes

We may change subscription prices from time to time.

A price change will not retroactively change the amount you have already paid for an existing billing period.

Where an increase applies to your next renewal, we will provide reasonable advance notice where required or appropriate.

If you do not wish to continue at the new price, you may cancel before the renewal to which the new price applies.

10. Your Instagram Exports and Other Content

You retain any rights you have in information and files that you upload to FindUnfollower.

You give us a limited, non-exclusive licence to host, copy, process and otherwise use that information only to the extent reasonably necessary to:

provide the Service to you;
generate your results;
maintain your account;
protect the Service against abuse or security threats;
troubleshoot technical problems; and
comply with legal obligations.

This licence ends when the relevant information is deleted from our active systems, except to the extent information must temporarily remain in backups or be retained where legally required.

Our Privacy Policy explains our data handling and retention practices in more detail.

11. Permission to Analyse Uploaded Information

You may only upload and analyse Instagram exports that:

relate to an Instagram account that you own; or
you have valid permission or legal authority to analyse.

You must not use FindUnfollower to obtain or process another person's private information without authorization.

Although Instagram exports may contain usernames or information relating to other Instagram users, you must use the Service responsibly and in accordance with applicable privacy, harassment and other laws.

12. Acceptable Use

You must not use FindUnfollower to:

violate applicable law or regulations;
harass, threaten, stalk, intimidate or unlawfully profile another person;
upload malware, malicious code or files intended to interfere with the Service;
gain unauthorized access to another user's account or information;
probe, scan or test vulnerabilities without our permission;
interfere with or disrupt the Service or its infrastructure;
deliberately circumvent account, subscription, usage, security or rate limits;
scrape, systematically extract or copy substantial portions of the Service;
reverse engineer the Service except where applicable law expressly permits it;
use automated systems in a manner that places unreasonable load on the Service;
resell, sublicense or white-label FindUnfollower without written permission;
misrepresent your relationship with FindUnfollower; or
use the Service in a manner that infringes another person's intellectual-property or other legal rights.

We may take reasonable technical measures to prevent abuse.

13. Your Decisions and Use of Results

FindUnfollower provides information derived from the data you upload.

We do not control what actions you take based on those results.

For example, whether you decide to follow, unfollow, block, contact or otherwise interact with another Instagram account is entirely your decision.

FindUnfollower does not make those changes to your Instagram account for you.

You should review results before relying on them, particularly because Instagram exports may be incomplete or may reflect historical rather than current information.

14. Availability and Maintenance

We aim to provide a reliable Service, but uninterrupted availability cannot be guaranteed.

The Service may occasionally be unavailable because of:

maintenance;
software updates;
infrastructure failures;
security incidents;
third-party service outages;
internet failures;
changes made by Instagram or Meta;
events outside our reasonable control; or
other technical reasons.

Where reasonably practical, we may provide notice of significant planned interruptions.

Temporary interruptions do not automatically entitle you to compensation, except where applicable law gives you such a right.

15. Changes to the Service

We may develop, improve or modify the Service over time.

This may include adding, changing or removing functionality where reasonably necessary because of:

product development;
technical requirements;
security;
changes to Instagram's export format or services;
legal or regulatory obligations;
third-party dependencies; or
low usage or sustainability of particular features.

We will not use this clause to remove core paid functionality arbitrarily during a paid subscription period where doing so would be contrary to applicable consumer law.

Where a change materially reduces the paid Service you have purchased, we will provide any notice, cancellation right, refund or other remedy required by applicable law.

16. Suspension and Termination

You may stop using FindUnfollower at any time.

You may delete your account through your account settings where account deletion is available.

We may restrict, suspend or terminate access to the Service where reasonably necessary, including where:

you materially violate these Terms;
your use creates a security risk;
your activity appears fraudulent or abusive;
payment is overdue or reversed;
we are required to do so by law;
continued provision would expose us or another person to material legal risk; or
you attempt to compromise the security or operation of the Service.

Where appropriate and reasonably possible, we will provide notice and an opportunity to remedy the issue before terminating an account.

Serious abuse, fraud or security threats may result in immediate suspension.

Termination does not affect rights and obligations that arose before termination.

17. Account Deletion and Data

Deleting your account is separate from cancelling a paid subscription unless the application explicitly states otherwise.

When you delete your account, information associated with the account will be handled in accordance with our Privacy Policy.

Certain records may need to be retained after account deletion where necessary for:

legal obligations;
payment and accounting records;
fraud prevention;
dispute resolution; or
security.

18. Intellectual Property

Except for information provided by users and third-party materials, the Service and its associated:

software;
user interface;
designs;
branding;
logos;
text;
graphics;
databases; and
other original content

are owned by or licensed to FindUnfollower and are protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service for its intended purpose.

This does not transfer ownership of the Service or our intellectual property to you.

“Instagram”, “Meta” and related marks are trademarks of their respective owners. Their use by FindUnfollower is solely for descriptive and compatibility purposes.

19. Third-Party Services

FindUnfollower depends on or integrates with services provided by third parties, which may include:

Google for authentication;
Stripe for payments;
cloud infrastructure providers;
email delivery providers; and
Instagram or Meta as the source of exports obtained by users.

We do not control third-party services and cannot guarantee their continued availability or functionality.

Your use of a third-party service may also be governed by that provider's terms and privacy policy.

Nothing in these Terms creates a partnership, endorsement or agency relationship between FindUnfollower and Instagram, Meta, Google or Stripe.

20. Privacy

Your privacy is important to us.

Our Privacy Policy explains:

what personal information we collect;
how we use it;
how Google user data is handled;
how Instagram exports are processed;
how information is stored and retained;
when information may be shared;
your privacy rights; and
how to request deletion.

The Privacy Policy forms part of our explanation of how the Service handles personal information but does not reduce any rights you have under applicable data-protection law.

21. Security

We use reasonable technical and organisational measures designed to protect the Service and personal information.

However, no internet service or storage system can guarantee absolute security.

You are responsible for using reasonable security practices when accessing your account, including protecting access to your email account and devices.

You must promptly notify us at info@findunfollower.com if you become aware of suspected unauthorized access to your FindUnfollower account.

22. Disclaimers

FindUnfollower is intended to provide analysis based on information supplied by you.

We do not guarantee that:

Instagram exports will always be complete or accurate;
Instagram will continue to provide exports in their current format;
every follower or unfollower result will reflect the current state of an Instagram account;
the Service will be uninterrupted or error-free; or
a particular feature will remain compatible with future changes made by Instagram or Meta.

To the extent permitted by law, the Service is provided on the basis described in these Terms.

Nothing in these Terms excludes or limits warranties, guarantees or rights that applicable consumer law does not allow us to exclude or limit.

23. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes or limits liability for:

death or personal injury caused by negligence where such liability cannot legally be excluded;
fraud or fraudulent misrepresentation;
deliberate misconduct where liability cannot legally be excluded; or
any consumer or statutory right that cannot legally be limited.

If you are a consumer, we are responsible for reasonably foreseeable losses caused by our breach of these Terms or failure to use reasonable care and skill, subject to applicable law.

We are not responsible for losses caused by circumstances outside our reasonable control.

We are also not responsible for actions independently taken by Instagram, Meta, Google or another third-party service provider, including the suspension or restriction of an account by such third parties, except to the extent applicable law provides otherwise.

Business users

If you use the Service wholly or mainly for business purposes, then, to the fullest extent permitted by law:

neither party will be liable for indirect or consequential loss;
we will not be liable for loss of profit, revenue, business opportunity, goodwill or anticipated savings; and
our aggregate liability arising from the Service will not exceed the amount you paid to FindUnfollower during the 12 months immediately preceding the event giving rise to the claim.

These business limitations do not apply to liability that cannot legally be excluded or limited.

24. Indemnity for Business Users

If you use FindUnfollower for business purposes, you agree to compensate us for reasonable losses, liabilities and costs resulting directly from:

your unlawful use of the Service;
information you upload without the required authority; or
your material violation of another person's rights,

to the extent permitted by applicable law.

This section does not apply to consumers to the extent that applying it would be prohibited or unfair under applicable consumer law.

25. Communications

We may send you communications necessary to operate your account, including:

authentication messages;
security notifications;
billing information;
subscription or renewal information;
important service notices; and
notices concerning these Terms or our Privacy Policy.

Transactional and legally required messages are separate from optional marketing communications.

Where required, you can separately choose whether to receive marketing emails.

26. Changes to These Terms

We may update these Terms where reasonably necessary because of changes to:

the Service;
applicable law;
security requirements;
our business structure;
third-party services; or
other legitimate operational requirements.

For minor or non-material changes, we may update the Terms by publishing the revised version and changing the “Last updated” date.

If we make a material change that significantly affects existing users' rights or obligations, we will provide reasonable advance notice, for example by email or through the Service, where required or appropriate.

Changes will not retroactively remove rights that have already accrued.

If applicable law requires your consent to a particular change, we will request that consent.

27. Governing Law and Disputes

These Terms are governed by the laws of England and Wales, except that if you are a consumer residing elsewhere, you retain the benefit of any mandatory consumer protections provided by the laws of your country of residence that cannot lawfully be excluded.

If you are a consumer, nothing in these Terms prevents you from bringing a claim in any court that applicable consumer law gives you the right to use.

If you are using the Service for business purposes, the courts of England and Wales will have exclusive jurisdiction over disputes arising from these Terms, unless we agree otherwise in writing.

28. General Terms

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

Our failure to enforce a provision immediately does not waive our right to enforce it later.

You may not transfer your rights under these Terms to another person without our consent, except where applicable law gives you that right.

We may transfer our rights and obligations as part of a merger, acquisition, corporate reorganisation or sale of the business, provided that doing so does not reduce mandatory rights you have as a consumer.

These Terms, together with any terms displayed at checkout and other policies expressly incorporated into them, constitute the agreement between you and FindUnfollower concerning use of the Service.

If information displayed at checkout conflicts with these Terms regarding the particular price, billing period or subscription you purchase, the specific information presented to you at checkout will take priority for that purchase.
